You can if you enjoy going to court and arguing with lawyers and having your online presence pushed to the bottom of Google search results. The mere fact that a work is publicly available does not imply that you are free to re-use it. Search engines just scan the internet for relevant results and present them to the user. The photographs you find using online search engines are likely to be copyright protected, which means you’ll need to ask the copyright owner for permission before utilising them.
The consequences of using copyrighted photos in your blog or posters without the consent of the copyright owners are determined by the laws of the jurisdiction where the infringement occurred. The copyright holder can simply write you a cease and desist letter or request that the images be removed from your website, post, image or blog.
If the copyright holder files a copyright infringement lawsuit against you in the United States and is successful, the following are the potential penalties:
- The exact cash amount of damages and profits obtained as a result of the infringement.
- For each image infringed, the court will award $150,000 in statutory damages.
- All legal fees and court costs are included.
- For a first crime, the penalty is five years in jail; for successive offences, the penalty is ten years in prison.
I am not a lawyer and cannot give legal advice, but in my experience, using copyrighted photos in one’s poster or blog is rarely detected by the copyright owners, but if you are caught, you may face the harshest copyright infringement penalties because it is still a crime.
